Terms of Service

1. Eligibility and accounts

You must be at least 18 years old and the parent or legal guardian of any child who uses the service. Children do not create their own accounts — you create the account, consent to the processing of your child’s data, and add each child profile. You are responsible for keeping your login details secure and for all activity under your account and your children’s profiles.

2. Parental responsibility

You confirm that you have the authority to consent to your child’s use of Vivarth and to the processing of their personal data. You are responsible for supervising your child’s use, for the accuracy of the information you provide, and for deciding what is appropriate for your child.

3. Acceptable use

You agree not to, and not to allow anyone to:

• Attempt to access other users’ accounts or data, or probe, scan, or breach security
• Disrupt or overload the service, or use bots/scrapers except as expressly allowed
• Misuse the Cosmo AI helper, or attempt to make it produce harmful or inappropriate content
• Copy, resell, or redistribute our lessons or content except as permitted
• Use the service unlawfully or to harm others

4. Subscriptions, billing and cancellation

Vivarth offers a free tier and paid plans. Paid plans may begin with a free trial; unless you cancel before the trial ends, the plan converts to a paid subscription and renews automatically for successive periods until cancelled. Payments are processed by Stripe. The price, currency, and billing period shown at checkout apply. You can cancel at any time from the parent dashboard; cancellation stops future renewals and takes effect at the end of the current billing period. Statutory withdrawal/refund rights under applicable consumer law (including EU/Dutch consumer rules) are unaffected. [Insert your specific refund policy.]

5. Educational content and the AI helper

Our lessons and the Cosmo AI helper are provided for learning and entertainment. AI responses are generated automatically and may be inaccurate or incomplete; they are not professional, educational, or any other kind of formal advice. We may add, change, or remove content and features.

6. Intellectual property

The Vivarth platform, brand, and content are owned by us or our licensors. We grant you a limited, personal, non-transferable licence to use the service for your family’s own non-commercial learning. Code your child writes in the platform remains yours.

7. Suspension and termination

You may stop using and delete your account at any time. We may suspend or terminate accounts that breach these terms or that we reasonably believe pose a security or legal risk. On deletion, data is handled as described in the Privacy Policy (30-day grace, then permanent deletion).

8. Disclaimers and limitation of liability

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited under applicable law, including your mandatory consumer rights. 9. Governing law and disputes
